Discover India Contest: T&C and Guidelines

1. About Discover India Contest

• Discover India Contest is an engagement activity for prospects that supports the entry Participation in a Quiz contest by Mahindra Holidays & Resorts India Limited (hereinafter referred to as ‘Club Mahindra’), where participants stand a chance of winning prizes offered by Club Mahindra.
• Participants will be reached through different channels (including but not limited to SMS, Facebook, Instagram, Twitter, Whatsapp etc,) to participate in Discover India Contest by answering quiz (Club Mahindra’s website/ microsite/SMS/Whatsapp) containing questions relating to heritage, food, destinations etc. at different locations across India. By submitting the entry/ies at the contest platform of Club Mahindra, the Participant gives his/ her/ their unequivocal & irrevocable consent to Club Mahindra to use their personal details so provided during submission of entries for further communication & media campaigns.
• The contest shall run for a limited period and entries shall be accepted only from 10^th March 2022 till 31^st March 2023; with the winner names being announced on 21^st May 2023 or such other date as may be decided by Club Mahindra at its own sole discretion.
• From a pool of Participants ( Who have participated through different platforms) who have given All correct answers to the quiz questions, 20 lucky winners will be selected by the Club Mahindra Team who shall be entitled to a family holiday for 2 Nights/ 3 Days at Select Club Mahindra Resort under a Holiday Voucher issued by Club Mahindra.
• All submissions and entries for the campaign/ contest shall be accepted at the sole discretion of Club Mahindra. Club Mahindra shall be entitled to reject any entry without assigning any reason.
• Please ensure that all information in the official entry submitted by you (Participant) is genuine, authentic & accurate. In case any entry is identified by Club Mahindra to be inaccurate, fake and/ or violating any of the legal/ ethical norms, the participant will be disqualified and their entry will not be accepted. In case Club Mahindra find that the participant has created his account only to participate in the contest, Club Mahindra may consider it to be invalid entry.
• The Participant alone shall be responsible and liable for all loss or damage caused due to any copyright or other intellectual property rights violation arising out of the content submitted by the Participant as part of the campaign/ contest. Club Mahindra, its promoters, partners, associates and sponsors shall not be liable for any legal or punitive action. By participating in the campaign/ contest, the Participant agrees to indemnify Club Mahindra, its promoters, partners, associates and sponsors from any and all liability arising out of a violation of copyright or other intellectual property rights arising out of the content submitted by the Participant

2.         Rules of participation 

• Only those users who are individuals and residents of India, except the existing Club Mahindra Members & their immediate family members, shall be eligible to participate in the contest.
• The Campaign/ Contest is not open to employees, distributors, franchisees, agents and suppliers of Mahindra Holidays & Resorts India Limited and their direct dependents, as also to the participants residing in the State of Tamil Nadu, India.
• Participants can submit an entry only once on any one platform . If they submit multiple entries, only the latest entry as per the time stamp (received chronologically) will be considered for evaluation.

• Participation does not guarantee a prize.
• The Campaign/ Contest is organized and managed by Club Mahindra, and Club Mahindra has complete authority on all the proceedings of the same. The decision of Club Mahindra as regards any aspect of this Campaign/ Contest shall be final & binding.
• The Contest period is as mentioned in the promotions and Club Mahindra shall have to right to change the same at its own sole discretion.

3. Results 

• The results as to the winner entitling him/ her/ them to the gift/ prize as to the contest will be declared by Club Mahindra on 21^st May 2023 or such other date as may be decided by Club Mahindra at its own sole discretion. In this regard, it is clarified that the decision of Mahindra Holidays & Resorts India Limited shall be final & binding on all participants, and no participant shall have the authority to challenge/ contest the same. Such instance of challenge/ contestation shall warrant disqualification.
• A total of 20 (Twenty only) Lucky winners will be awarded prizes (provided there are at least ____ valid entries). Prizes shall be given only for valid entries & Participants who have answered all questions correctly in stipulated timeline. Basis for selection of winners shall remain confidential & at the sole discretion of Club Mahindra and Club Mahindra shall be under no obligation of any kind to share the modalities with any participant and no such demand shall lie against the Company.
• The prize/ gifts for the winners cannot be exchanged for cash or transferred. No alternate gift / prize or offer shall be provided by Club Mahindra in lieu of the Contest Prize
• The winners shall be entitled to receive his/ her gift/ prize by way of Holiday Voucher only on their registered Email Id.

• Club Mahindra shall have the right to refuse prizes/ gifts to any of the Participant/ Winner in case his/her previous Club Mahindra Membership was found to be rescinded for breach of any of its terms & conditions or he/ she is considered ineligible for having a Club Mahindra Membership. Decision of Club Mahindra in this regard shall be final
• Taxes, levies etc. as applicable on prizes/ gifts shall be payable by the winner upfront in the manner as may be specified by Club Mahindra and the Company will not be liable to reimburse the same.

4. General 

• All the contents/ information submitted by the Participant for the Contest shall be the property of Club Mahindra and Club Mahindra shall be entitled to use the same for any purpose and in any manner whatsoever at its sole discretion. The Participant shall not be entitled to claim privacy, copyright or any other rights/ entitlements over the same.
• Any lapse in communicating with the winner due to false emails/ addresses provided by the winners via contest entry process and/ or for any other technical glitch/ reasons will not be the responsibility of Club Mahindra, and the winner will be treated as void in such cases.
• The Prize/ gift as to the family holiday for 2 Nights/ 3 Days at Select Club Mahindra Resort shall be provided by way of a Holiday Voucher and availing/ booking and all other relevant aspects as to such holiday shall be governed by the terms and conditions of the Holiday Voucher. Under the Holiday Voucher, the Winner will be entitled for accommodation only at the designated resorts within the designated dates as detailed in the Holiday Voucher and all other charges, including food, to & from expenses, sight-seeing and all other activities shall be borne by the Participant/ Winner only.
• Club Mahindra reserves its rights to exclude its one or more resorts from the purview of this contest and/ or change dates as to bookings under the Holiday Voucher. The Holiday Vouchers as given shall be governed by their respective terms & conditions. Visuals displayed here are representations & may vary from the actual in terms of make, brand, weight, color, model & merchantability.
• Club Mahindra does not guarantee confirmed holiday or any other aspect relating to holiday confirmed usage of the prizes and any claim in respect of same shall not lie against Club Mahindra. The Winner shall be required to first register the Holiday Voucher at the designated Club Mahindra’s website by submitting all the relevant details therein and avail the holiday at the chosen dates and resort by way of online booking at the Club Mahindra’s website. Upon booking, a Confirmation Voucher shall be issued by Club Mahindra in the name of the Winner (per details provided at the time of registration of the Holiday Voucher). All holiday bookings under the Holiday Vouchers shall be subject to availability at the designated resorts at the relevant time of booking.
• The Holiday Voucher/ Confirmation Voucher once issued cannot be transferred/ amended in any manner whatsoever.
• Club Mahindra shall not be liable for any delay/ failure to comply with its obligation caused by weather conditions, fire, flood, strike, war, political unrest, riots, accidents, act of God or any other unavoidable reasons beyond its control.
• In the event, it is discovered the Participant is either breaching the terms and conditions or is in-eligible to participate any prize won by the participant shall stand withdrawn and the participation shall stand invalidated..
• Club Mahindra reserves the right to modify, add or delete any of the terms and conditions or participation mechanics of the contest at any point of time at its sole discretion, without serving any prior intimation to the participants. Intimation of any change, modification, addition, deletion in the terms and condition of the contest will be served to the Participant by posting the revised terms and condition of the Contest on the contest portal/ social media campaign page/s.
• Club Mahindra Holidays does not take any responsibility for any content/ details submitted by the participants, and reserves its rights to direct the possible claimants to the participants/ contestants in the respect of the content submitted by the participants.
• Club Mahindra may collect personally identifiable information that you provide to us, such as your name, phone number, email address ETC which may be used by Mahindra Holidays & Resorts India Limited for its internal and promotional purposes. Mahindra Holidays & Resorts India Limited may also access profile and other information from Social media platforms.
• No other offers can be clubbed with this Contest.
• Any disputes with regards to the contest shall be referred to arbitration by a Sole Arbitrator appointed by Club Mahindra in terms of the Arbitration and Conciliation Act 1996, at Mumbai, as such the agreement will be subject only to the jurisdiction of the courts in Mumbai.
• By participating in the contest, the participants agree to abide by the Terms and Conditions of participation.
• All submissions and entries for the campaign/ contest shall be accepted at the sole discretion of Club Mahindra.
