1. About Fantastic Family Show
1.1. Fantastic Families Show Contest ( “Contest”) is an engagement activity for Club Mahindra Members (having existing Club Mahindra Holiday Membership/s) as well as for Prospects (persons wishing and exploring options to purchase Club Mahindra Membership/s), organised by Mahindra Holidays & Resorts India Limited ( “Club Mahindra”) where participants stand a chance of participation in the Fantastic Family Show (“Game Show”) organised by Club Mahindra at its microsite and winning prizes offered by Club Mahindra.
1.2. The Contest shall run for a limited period and entries for participation shall be accepted only from 11th Jan [SKR1] 2021 till 28th Feb 2020 (both dates inclusive). The names of the participants shortlisted to participate in the Game Show will be announced every week through SMS, tele-calling and email. The Winner of the respective Game Shows shall be entitled to the prizes as details below/ decided by Club Mahindra from time to time.
1.3. To participate in the Contest, Participants must submit the contest entry at the Club Mahindra Fantastic Families Show Microsite https://www.clubmahindra.com/fantasticfamilyshow only by submitting field entries and a family holiday photo.
1.4. From a pool of registrations, 1500+ participants will be selected to participate in the Game Show to be telecast live at the Microsite and to win the Prizes as mentioned below as well as at the microsite.
1.5. All submissions and entries for the Contest shall be accepted at the sole discretion of Club Mahindra. Club Mahindra shall be entitled to reject any entry without assigning any reason.
1.7. The pictures as submitted by the Participants in course of the Contest may be used by Club Mahindra for posting at different social media channels as part of its campaign, to showcase holiday memories as experienced by different persons. While posting such pictures/ their representation as mentioned above, Club Mahindra may share/ mention/ display the name & details of the participants at different media/ social media channels By submitting its entry/ies, the Participant gives his/ her/ their unequivocal & irrevocable consent to Club Mahindra to use their submitted entries/ pictures as part of their campaign/s & other media commercials.
1.8. Please ensure that all information and photograph/s in the official entry submitted by you (Participant) is genuine, authentic & accurate and does not violate the policies of the social media channel and/ or showcase nudity, hatred or any other unethical or illegal acts. In case we identify an entry to be inaccurate, fake and/ or violating any of the legal/ ethical norms, the Participant will be disqualified, and their entry will not be accepted. In case we find that the Participant has created his/ her account only to participate in the Contest, Club Mahindra may consider it to be an invalid entry.
1.9. The Participant alone shall be responsible and liable for all loss or damage caused due to any copyright or other intellectual property rights violation arising out of the content submitted by the Participant as part of the Contest. Club Mahindra, its promoters, partners, associates and sponsors shall not be liable for any legal or punitive action. By participating in the Contest, the Participant agrees to indemnify Club Mahindra, its promoters, partners, associates and sponsors from any and all liability arising out of a violation of copyright or other intellectual property rights arising out of the content submitted by the Participant.
2. Contests, Eligibility & Qualification
2.1. All Club Mahindra Members as well as the Non- members (“Prospects”) who are wishing and exploring options to purchase Club Mahindra Membership/s are eligible to participate in this Contest.
2.2. The Participants will be required to upload picture/ photograph of their favourite holiday memories on the Fantastic Families Show Microsite only, after signing up with his/ her/ their relevant details (including name, address , phone number, e-mail ID, and such other details required to be mentioned.
2.3. To participate, the Participant will have to answer all the questions given at the microsite and upload one of their favourite family photos. Once submitted, the participant will receive Emails, SMSes and calls to progress to the further steps
2.4. From a pool of registrations, 1500+ (one thousand five hundred) entries will be selected, by a jury appointed by Club Mahindra, to participate in the Game Show which will be broadcast live at the Microsite. The Game Show shall be an interactive culmination point based contest having different rounds of quiz and games for the participants and their family members. The date, time and conduct of the Game Show shall be at sole discretion of Club Mahindra. No requests for change of date, time etc. shall be entertained.
The Game Show will be conducted virtually and the selected Participants will have to participate online through the mode and in the manner as contemplated by Club Mahindra for the purpose. The Participants will have to ensure proper connectivity and all related logistics in this regard at his/ her/ their own costs and efforts. Club Mahindra does not guarantee or warranty seamless participation on part of the Participants and Club Mahindra shall not be liable for any interruption or disruption, for network issues, connectivity or any other reasons, leading to the Participate being not able to participate in the Game Show.
2.1.5. The Winners of respective Game Shows conducted with participation of different selected Participants (approx. 250+ Winner/s) will be eligible for a 2Nights/3 Days holiday voucher (“Voucher”) for being entitled to holiday at a Club Mahindra Resort in India.
The Participants will have to abide by the terms & conditions as contained in the Voucher to avail the benefits there under. The validity and other terms and conditions for utilization of the Voucer will be shared by Club Mahindra with the winning participants via email.
3. Rules of Participation
3.1. Only those Persons who are individuals and residents of India shall be eligible to participate in the campaign/ contest.
3.2. The Contest is not open to employees, distributors, franchisees, agents and suppliers of Club Mahindra/ Mahindra Holidays & Resorts India Limited and their direct dependents.
3.3. Photograph Guidelines: All the photographs/s pictures so submitted by the Participant will be moderated and published by Club Mahindra Team, provided they match the guidelines as mentioned below:
a. Photos should be bright. It should showcase the Participant’s family as per the relevant team chosen. Photos should not be dark, difficult to view, blurry or altered in any way that distorts the scene.
b. Photos should be in the correct orientation.
c. Photos should not exceed 5 MB in size and should be in the following formats: jpg, or png format.
d. Photos will be scaled to fit the standard display boxes on our site.
e. Photos should follow all community guidelines i.e. the photos should be an original photo taken by the Participant or his family.
f. No use of any image that has derogatory or abusive content
g. Photos should not promote the Participant’s or any other person’s own business or service or be used for personal promotion.
3.4. Participation does not guarantee selection for Game Show and/ or a Prize.
3.6. The Contest is organized and managed by Club Mahindra, and Club Mahindra has complete authority on all the proceedings of the same. The decision of Club Mahindra as regards any aspect of this Contest shall be final & binding.
3.7. The Contest period is as mentioned in the promotions and Club Mahindra shall have the right to change the same at its own sole discretion.
4. Results
4.1. The results as to the Game Show Winner entitling him/ her/ them to the gift/ prize will be declared by the show host at the end of every show, based on the points collected and other relevant criterion of the Show. In this regard, it is clarified that the decision of the host/ Club Mahindra shall be final & binding on all participants, and participant shall not have the authority to challenge/ contest the same. Such instance of challenge/ contestation shall warrant disqualification.
4.2. Basis for selection of Participants to participate in the Game Show as well of the Winners at the Game Show shall remain confidential & at the sole discretion of Club Mahindra/ its jury and Club Mahindra shall be under no obligation of any kind to share the modalities with any participant and no such demand shall lie against Club Mahindra/ Mahindra Holidays & Resorts India Limited.
4.3. Any participant whose existing/ earlier Club Mahindra Membership is/ was restricted, cancelled, terminated or kept in abeyance, for the reasons of overdues in respect of his/ her/ their Membership and/ or for breach of any of the terms and conditions of the Membership rules, shall be entitled to participate in the Contest and/ or to claim & receive gift/ prizes under the contest only after full payment of the overdue amounts and/ or rectifying breach of the Membership Rules.
4.4. The prize/ gifts for the winners cannot be transferred or exchanged for cash. No alternate gift / prize or offer shall be provided by Club Mahindra in lieu of the Contest Prize.
4.5. The winners shall be required to submit relevant documents as may be requested/ stipulated by Club Mahindra, including but not limited to their identity & address proof etc., for claiming their gift/ prize.
4.6. The winners shall be entitled to receive his/ her gift/ prize only post verification of the credentials (as mentioned above).
The Winner of the holiday Vouchers shall have to attend a brief presentation from Club Mahindra as to the Membership before/ during availment of benefits under the Voucher. Non- attendance as to the presentation shall disentitle the Winner from availing the benefits under the Voucher.
4.7. Taxes, levies etc. as applicable on prizes/ gifts shall be payable by the winner upfront in the manner as may be specified by Club Mahindra and Mahindra Holidays & Resorts India Limited/ Club Mahindra will not be liable to reimburse the same
5. General
5.1. All the contents submitted by the Participant for the Contest shall be the property of Club Mahindra and Club Mahindra shall be entitled to use the same for any purpose whatsoever at its sole discretion, including for marketing and promotion of its products and services. The Participant shall not be entitled to claim privacy, copyright or any other rights/ entitlements over the same.
5.2. Any lapse in communicating with the winner due to false/ incorrect details/ emails/ addresses etc. provided by the winners via contest entry process and/ or for any other technical glitch/ reasons will not be the responsibility of Club Mahindra, and the winner will be treated as void in such cases.
5.3. Club Mahindra does not guarantee or warranty merchantability, fitness or quality of the prizes or services there under. Visuals displayed here are representations & may vary from the actual in terms of location, season etc.
5.4. All bookings shall be subject to eligibility and availability at the relevant point of time. Club Mahindra may at its sole discretion exclude any of its Resorts for bookings by the Contest winner/s.
5.5. Process of distribution of prizes may take 3 to 4 weeks’ period after receipt of all the relevant documents and no claim shall lie for delay in distributing the prizes.
5.6. In the event, it is discovered the Participant is either breaching the terms and conditions or is in-eligible to participate, any prize won by the participant shall stand withdrawn and the participation shall stand invalidated.
5.7. Club Mahindra shall not be liable for any delay/ failure to comply with its obligation caused by weather conditions, fire, flood, strike, war, political unrest, riots, accidents, epidemic, government regulations, statutory or administrative restrictions, act of God or any other unavoidable reasons beyond its control.
5.8. Club Mahindra reserves the right to modify, add or delete any of the terms and conditions or participation mechanics of the Contest at any point of time at its sole discretion, without serving any prior intimation to the participants. Intimation of any change, modification, addition, deletion in the terms and condition of the Contest will be served to the Participant by posting the revised terms and condition of the Contest on the microsite/ campaign page/s.
5.9. Club Mahindra does not take any responsibility for any content submitted by the participants, and reserves its rights to direct the possible claimants to the participants/ contestants in the respect of the content submitted by the participants.
5.10. Club Mahindra may collect personally identifiable information that you provide to us, such as your name, member ID, phone number or email address etc. which may be used by Club Mahindra for its internal and promotional purposes. Club Mahindra may also access profile and other information from Social media platforms.
5.11. No other offers can be clubbed with this Contest.
5.12. This campaign/ contest is an engagement activity for Club Mahindra Members & Prospects and be not treated as a lucky draw or a game of chance.
5.13. Any disputes with regards to the contest shall be referred to arbitration by a Sole Arbitrator appointed by Club Mahindra in terms of the Arbitration and Conciliation Act 1996, at Mumbai, as such the agreement will be subject only to the jurisdiction of the courts in Mumbai.
5.14. By participating in the campaign/ contest, the participants agree to abide by the Terms and Conditions of participation.
5.15. All submissions and entries for the campaign/ contest shall be accepted at the sole discretion of Club Mahindra.
